CEREBRAL PALSY TREATMENT - CLINICAL CLAIMSThere is no cerebral palsy treatment that can repair damage to the brain. These irreversible injuries result not only in serious medical problems but also social, emotional and educational disabilities. There are a variety of therapies, designed to manage and control the disability and to improve the quality of life of anyone suffering from this debilitating condition. The most common treatment is physical therapy which is often complimented by the selective use of pharmaceutical drugs and surgery in extreme cases. Probably the first thing that will be suggested when consideration is given to cerebral palsy treatment is physical therapy which involves participating in exercises designed to control the contractions that define the disorder. This therapy can improve the motor skill development of a child if employed early enough in life. Cerebral palsy treatment may require the application of many different medications including tranquilisers and muscle relaxants which help to reduce the frequency of spasms and anticonvulsant drugs to calm seizures however most of these medications are only short term solutions to long term problems. Surgery is used as a cerebral palsy treatment option in extreme cases when the muscle contractures for an individual become unbearable. Surgeons can lengthen the muscles and tendons to release tension and can also reduce the net amount of nervous stimulation that the muscles accept from the damaged areas of the brain thereby reducing spasms and discomfort. Approximately 10% of all cases are the result of medical negligence with the remainder being due to naturally occurring phenomena. If your child’s disability has been caused by the errors of a healthcare professional then you should consider taking legal action to secure your child’s financial future. Legal aid is almost always available for children with no contribution being necessary from the parents. The eligibility for public funding depends on the income and assets of the child and not the parents. All of our solicitors are members of the Law Society panel of clinical negligence experts and are authorized to make an immediate application for public funding which applies to less than 1% of the lawyers in the UK. The Limitation Act 1980 applies to all personal injury cases and whilst the primary time limit is three years for either settling claims or issuing proceedings in a court of law there are extensions for minors and the mentally disabled. The three year period does not start to run until a potential claimant achieves the age of 18 years and time may never run against those who are unable to look after their own affairs. In addition the court has a wide discretion to extend and amend time limits but this discretion is rarely exercised. Limitation is a complex legal issue and advice should always be obtained personally from a qualified solicitor.
